General provisions<\/h2>\nThese <strong>General Terms and Conditions of Sale<\/strong> (GTCS) apply, without restriction or reservation, to all sales made by <strong>KISSAFRICA<\/strong>, whose registered office is located at <strong>7 all\u00e9e de la Com\u00e9die, 59650 Villeneuve-d\u2019Ascq<\/strong>, registered with the <strong>Lille M\u00e9tropole Trade and Companies Register under number 940 352 461<\/strong>\u00a0(hereinafter referred to as the \u201cSELLER\u201d), to buyers (hereinafter referred to as the \u201cCUSTOMER\u201d) wishing to purchase the products offered by the SELLER on the <strong>kissafrica.fr<\/strong> website.\n\nThese GTCS are intended to:\n<ul>\n \t<li><strong>Inform the CUSTOMER<\/strong> of the conditions and procedures for sale, as well as delivery of the products ordered.<\/li>\n \t<li><strong>Define the rights and obligations<\/strong> of the parties in the context of product sales between the SELLER and the CUSTOMER.<\/li>\n<\/ul>\nThey apply to all orders placed with <strong>KISSAFRICA<\/strong> for all products offered on its website. The parties agree that this contract is governed by <strong>French law<\/strong>.\n\nBy placing an order, the buyer, a natural person over 18 years of age, accepts these GTCS without reservation and acknowledges having read them beforehand. The buyer also declares that they have full legal capacity to enter into commitments under these terms.\n<h2>2. Prices<\/h2>\n<strong>Prices and billing terms<\/strong>\n\nThe selling prices of products offered online on the <strong>KISSAFRICA<\/strong> website are stated in euros. They are displayed <strong>inclusive of all taxes (TTC)<\/strong>, but <strong>exclusive of shipping costs<\/strong>. These shipping costs are charged in addition, based on the total weight of the order and\/or the total purchase amount. The exact costs are communicated to the buyer before the order is confirmed.\n\nPrices include the <strong>value added tax (VAT)<\/strong> applicable on the date of the order. If the VAT rate changes, that change will automatically be reflected in the price of the products.\n\n<strong>Price changes<\/strong>\nPrices displayed on the <strong>KISSAFRICA<\/strong> website may be changed at any time without prior notice.\n\n<strong>Promotions and sales<\/strong>\nPromotions or sales may be offered in accordance with the statutory sales dates in France.\n\n<strong>General Terms and Conditions of Sale<\/strong>\nThese <strong>General Terms and Conditions of Sale (GTCS)<\/strong> are intended to:\n<ul>\n \t<li><strong>Inform the CUSTOMER<\/strong> of the conditions and procedures for sale and delivery of the products ordered.<\/li>\n \t<li><strong>Define the rights and obligations<\/strong> of the parties in the context of product sales.<\/li>\n<\/ul>\nThese GTCS apply to all orders placed with <strong>KISSAFRICA<\/strong> for products offered on its website. The parties agree that this contract is governed by <strong>French law<\/strong>.\n\nThe buyer, an adult natural person (over 18 years of age), accepts these GTCS without reservation by placing an order. The buyer acknowledges having read them and declares having full legal capacity to enter into commitments.\n<h2>3. Products<\/h2>\n<strong>Description and conformity of products<\/strong>\n\nEach product is accompanied by a detailed description enabling the customer to know its essential characteristics.\n\nHowever, the information and product sheets on the <strong>KISSAFRICA<\/strong> website cannot be guaranteed to be exhaustive or error-free. If the characteristics of the delivered product do not conform to those expected by the buyer, the buyer may exercise their <strong>right of withdrawal<\/strong> in accordance with the terms set out below.\n\n<strong>Statutory warranty<\/strong>\n<strong>KISSAFRICA<\/strong> guarantees the conformity of the products, subject to the preceding provisions, in accordance with the articles of the <strong>Consumer Code<\/strong>. Products sold also benefit from the <strong>statutory warranty against hidden defects<\/strong>.\n\n<strong>Retention of title<\/strong>\n<strong>KISSAFRICA<\/strong> retains full ownership of the products sold until the price has been paid in full, including principal, charges and taxes.\n<h2>4. Product availability<\/h2>\n<strong>Product availability<\/strong>\n\nProduct offers are valid while stocks last.\n\nIf a product is unavailable when an order is placed, the sale will be cancelled and any amount paid by the buyer will be refunded as soon as possible and no later than <strong>thirty days<\/strong>.\n\n<strong>KISSAFRICA<\/strong> reserves the right to change its product range, in particular according to constraints relating to its suppliers and\/or inventory.\n\nAvailable stock is displayed on the site when the order is placed. Orderable quantities are limited to those available that day. However, some products may be restocked.\n<h2>5. Orders<\/h2>\n<strong>Order confirmation<\/strong>\n\nAny order placed on the site entails full and complete acceptance of these <strong>General Terms and Conditions of Sale (GTCS)<\/strong>.\n\nAn order acquires contractual value only after <strong>KISSAFRICA<\/strong> sends an acknowledgement of receipt by email. This acknowledgement confirms all elements of the order form, in particular the price and quantity, without any alteration.\n\n<strong>Preparation and packaging of orders<\/strong>\n\nOrders are carefully prepared and packaged with the utmost care.\nUpon simple request specified when ordering, <strong>gift wrapping<\/strong> may be provided at no extra charge.\n<h2>6. Payment<\/h2>\n<strong>Payment terms<\/strong>\n\nPayment must be made by the buyer when the order is placed. All orders are payable in <strong>euros<\/strong> and must be paid <strong>in full<\/strong>.\n\n<strong>Available payment methods<\/strong>:\n<ol>\n \t<li><strong>Bank card<\/strong> (all types), via our provider&#8217;s secure site.<\/li>\n \t<li><strong>PayPal<\/strong>.<\/li>\n \t<li><strong>Cheque<\/strong> (subject to receipt and clearance before the order is shipped).<\/li>\n \t<li><strong>Bank transfer<\/strong> (bank details will be provided when the order is placed).<\/li>\n<\/ol>\n<h2>7. Delivery<\/h2>\n<strong>Delivery terms<\/strong>\n\nDelivery is made by the carrier selected by <strong>KISSAFRICA<\/strong>. Products are delivered to the address indicated by the buyer when placing the order.\n\n<strong>Available delivery methods<\/strong>:\n<ol>\n \t<li><strong>Collection Point<\/strong>: delivery to the collection point selected by the customer when placing the order.<\/li>\n \t<li><strong>Other shipping methods<\/strong>: at the discretion of <strong>KISSAFRICA<\/strong>, according to logistical needs or constraints.<\/li>\n<\/ol>\n<strong>Delivery costs<\/strong>\nShipping costs are borne by the buyer and are specified before the order is confirmed.\n\n<strong>Invoicing<\/strong>\nInvoices are available in the <strong>\u201cOrder history and details\u201d<\/strong> section of the customer account. A link providing direct access is also sent by email to the address entered by the buyer at registration.\n<h2>8. In-store collection<\/h2>\n<strong>In-store collection<\/strong>\n\nIf the buyer chooses to collect their order from the <strong>Kissafrica<\/strong> store, located at <strong>19 rue d&#8217;I\u00e9na, 59000 Lille<\/strong>, they have <strong>15 days<\/strong> after payment to collect their parcel.\n\n<strong>Opening hours<\/strong>\nThe order may be collected during the store&#8217;s opening hours:\n<strong>from 9:30 a.m. to 7:30 p.m., every day<\/strong>. The store may be closed for holidays; the buyer is therefore advised to check opening hours before travelling.\n\n<strong>Collection conditions<\/strong>\nThe order will be handed to the buyer on presentation of the supporting documents sent by email when the order and payment were confirmed.\n<h2>9. Time limits<\/h2>\n<strong>Delivery times and liability<\/strong>\n\nDelivery times begin to run upon receipt of payment. They are provided as an <strong>indication<\/strong> and correspond to average processing and transport times.\n\n<strong>KISSAFRICA<\/strong> may not be held liable for consequences related to a delivery delay beyond its control.\n\n<strong>Order processing<\/strong>\nOrders are shipped on the same day or, at the latest, on the following working day. However, delivery times may vary in the event of transport difficulties.\n\n<strong>Receipt of damaged parcels<\/strong>\nIf a damaged parcel is received (opened, missing products, etc.), the buyer undertakes to report their reservations to the carrier and to <strong>KISSAFRICA<\/strong> within <strong>3 days<\/strong> of receiving the product, by any means of communication.\n<h2>10. Right of withdrawal<\/h2>\n<strong>Right of withdrawal<\/strong>\n\nThe private customer has a <strong>right of withdrawal<\/strong> that may be exercised within <strong>fourteen clear days<\/strong> from delivery of the order.\n\nTo exercise this right, the customer must return, at their own expense, new products to the following address:\n<strong>KISSAFRICA<\/strong>\n<strong>7 all\u00e9e de la Com\u00e9die<\/strong>\n<strong>59650 Villeneuve-d\u2019Ascq<\/strong>\n\nProducts must be returned:\n<ul>\n \t<li>With the <strong>order number<\/strong>.<\/li>\n \t<li><strong>In their original packaging<\/strong>, unused and unopened.<\/li>\n<\/ul>\n<strong>Refund<\/strong>\n<strong>KISSAFRICA<\/strong> will refund the buyer amounts already paid, <strong>less shipping costs<\/strong>.\n<h2>12. Applicable law and competent jurisdiction<\/h2>\n<strong>Applicable law and competent jurisdiction<\/strong>\n\nProduct sales made by <strong>KISSAFRICA<\/strong> are subject to <strong>French law<\/strong>.
