General Terms and Conditions of Sale
1. General provisions
These
General Terms and Conditions of Sale (GTCS) apply, without restriction or reservation, to all sales made by
KISSAFRICA, whose registered office is located at
7 allée de la Comédie, 59650 Villeneuve-d’Ascq, registered with the
Lille Métropole Trade and Companies Register under number 940 352 461 (hereinafter referred to as the “SELLER”), to buyers (hereinafter referred to as the “CUSTOMER”) wishing to purchase the products offered by the SELLER on the
kissafrica.fr website.
These GTCS are intended to:
- Inform the CUSTOMER of the conditions and procedures for sale, as well as delivery of the products ordered.
- Define the rights and obligations of the parties in the context of product sales between the SELLER and the CUSTOMER.
They apply to all orders placed with
KISSAFRICA for all products offered on its website. The parties agree that this contract is governed by
French law.
By placing an order, the buyer, a natural person over 18 years of age, accepts these GTCS without reservation and acknowledges having read them beforehand. The buyer also declares that they have full legal capacity to enter into commitments under these terms.
2. Prices
Prices and billing terms
The selling prices of products offered online on the
KISSAFRICA website are stated in euros. They are displayed
inclusive of all taxes (TTC), but
exclusive of shipping costs. These shipping costs are charged in addition, based on the total weight of the order and/or the total purchase amount. The exact costs are communicated to the buyer before the order is confirmed.
Prices include the
value added tax (VAT) applicable on the date of the order. If the VAT rate changes, that change will automatically be reflected in the price of the products.
Price changes
Prices displayed on the
KISSAFRICA website may be changed at any time without prior notice.
Promotions and sales
Promotions or sales may be offered in accordance with the statutory sales dates in France.

General Terms and Conditions of Sale (GTCS) are intended to:
- Inform the CUSTOMER of the conditions and procedures for sale and delivery of the products ordered.
- Define the rights and obligations of the parties in the context of product sales.
These GTCS apply to all orders placed with
KISSAFRICA for products offered on its website. The parties agree that this contract is governed by
French law.
The buyer, an adult natural person (over 18 years of age), accepts these GTCS without reservation by placing an order. The buyer acknowledges having read them and declares having full legal capacity to enter into commitments.
3. Products
Description and conformity of products
Each product is accompanied by a detailed description enabling the customer to know its essential characteristics.
However, the information and product sheets on the
KISSAFRICA website cannot be guaranteed to be exhaustive or error-free. If the characteristics of the delivered product do not conform to those expected by the buyer, the buyer may exercise their
right of withdrawal in accordance with the terms set out below.
Statutory warranty
KISSAFRICA guarantees the conformity of the products, subject to the preceding provisions, in accordance with the articles of the
Consumer Code. Products sold also benefit from the
statutory warranty against hidden defects.
Retention of title
KISSAFRICA retains full ownership of the products sold until the price has been paid in full, including principal, charges and taxes.
4. Product availability
Product availability
Product offers are valid while stocks last.
If a product is unavailable when an order is placed, the sale will be cancelled and any amount paid by the buyer will be refunded as soon as possible and no later than
thirty days.
KISSAFRICA reserves the right to change its product range, in particular according to constraints relating to its suppliers and/or inventory.
Available stock is displayed on the site when the order is placed. Orderable quantities are limited to those available that day. However, some products may be restocked.
5. Orders
Order confirmation
Any order placed on the site entails full and complete acceptance of these
General Terms and Conditions of Sale (GTCS).
An order acquires contractual value only after
KISSAFRICA sends an acknowledgement of receipt by email. This acknowledgement confirms all elements of the order form, in particular the price and quantity, without any alteration.
Preparation and packaging of orders
Orders are carefully prepared and packaged with the utmost care.
Upon simple request specified when ordering,
gift wrapping may be provided at no extra charge.
6. Payment
Payment terms
Payment must be made by the buyer when the order is placed. All orders are payable in
euros and must be paid
in full.
Available payment methods:
- Bank card (all types), via our provider’s secure site.
- PayPal.
- Cheque (subject to receipt and clearance before the order is shipped).
- Bank transfer (bank details will be provided when the order is placed).
7. Delivery
Delivery terms
Delivery is made by the carrier selected by
KISSAFRICA. Products are delivered to the address indicated by the buyer when placing the order.
Available delivery methods:
- Collection Point: delivery to the collection point selected by the customer when placing the order.
- Other shipping methods: at the discretion of KISSAFRICA, according to logistical needs or constraints.
Delivery costs
Shipping costs are borne by the buyer and are specified before the order is confirmed.
Invoicing
Invoices are available in the
“Order history and details” section of the customer account. A link providing direct access is also sent by email to the address entered by the buyer at registration.
8. In-store collection
In-store collection
If the buyer chooses to collect their order from the
Kissafrica store, located at
19 rue d’Iéna, 59000 Lille, they have
15 days after payment to collect their parcel.
Opening hours
The order may be collected during the store’s opening hours:
from 9:30 a.m. to 7:30 p.m., every day. The store may be closed for holidays; the buyer is therefore advised to check opening hours before travelling.
Collection conditions
The order will be handed to the buyer on presentation of the supporting documents sent by email when the order and payment were confirmed.
9. Time limits
Delivery times and liability
Delivery times begin to run upon receipt of payment. They are provided as an
indication and correspond to average processing and transport times.
KISSAFRICA may not be held liable for consequences related to a delivery delay beyond its control.
Order processing
Orders are shipped on the same day or, at the latest, on the following working day. However, delivery times may vary in the event of transport difficulties.
Receipt of damaged parcels
If a damaged parcel is received (opened, missing products, etc.), the buyer undertakes to report their reservations to the carrier and to
KISSAFRICA within
3 days of receiving the product, by any means of communication.
10. Right of withdrawal
Right of withdrawal
The private customer has a
right of withdrawal that may be exercised within
fourteen clear days from delivery of the order.
To exercise this right, the customer must return, at their own expense, new products to the following address:

Products must be returned:
- With the order number.
- In their original packaging, unused and unopened.
Refund
KISSAFRICA will refund the buyer amounts already paid,
less shipping costs.
12. Applicable law and competent jurisdiction
Applicable law and competent jurisdiction
Product sales made by
KISSAFRICA are subject to
French law. The language used for this contract is the
French language.
In the event of a dispute relating to the interpretation, performance or termination of the contract concluded between
KISSAFRICA and the buyer, and in the absence of an amicable agreement, settlement of the dispute shall fall within the
exclusive jurisdiction of the courts of Lille, even in the event of multiple defendants.
13. “Information Technology and Civil Liberties”
This site was declared to the CNIL under number 1672184.
Protection of personal data
In accordance with the amended
Information Technology and Civil Liberties Act No. 78-17 of 6 January 1978, you have the following rights concerning your personal data:

Google Analytics statistical tool, which records non-personal information on each visit. No personal data are collected under this statistical data policy.
The site also uses a
cookie to remember your preferences during the order process. No personal data are collected through this cookie.
